Climate Fresk is a three-hour educational tool, based on a deck of 44 cards for the adult version and 23 cards for the children version, designed for participants to understand the causes and consequences of climate change. The information shown on the cards is mainly sourced from IPCC reports. The tool is based on a number of formalised elements such as the cards, their content, the correction (set of links between the cards) and the workshop proceedings.
The author of the Climate Fresk, as described above, is Cédric Ringenbach (hereinafter “the Author”), owner of the copyright on the work and, in particular, on the content of the cards, as well as the French trademark (“La Fresque du Climat”), the English trademark (“Climate Fresk”) and the translations of the trademark into other languages.
According to a licence agreement dated 10 July 2019 extended by amendment on 13 November 2023, the Author has granted the association “La Fresque du Climat” (hereinafter “the Association”) the exclusive rights to use the French trademark “La Fresque du Climat” and the game “La Fresque du climat”. As a result, the Association may define the conditions of use of La Fresque du Climat and collect the royalties for commercial use or use within an organisation (see below).

Non-Commercial and Non-Professional Use

The “Climate Fresk” tool can be used free of charge for any free event facilitated by a volunteer facilitator. Free of charge use is also permitted for teaching activities in private or public primary, secondary or higher education establishments, with the exception of adult education. As such, teachers are authorised to use Climate Fresk as part of their professional activity, during their paid working hours.
The right to use the Fresk free of charge as part of an educational establishment activities should be differentiated from the facilitating or training services that may be offered by service providers or the Association itself.
Such free and non-commercial use does not allow the content of the cards to be modified.
The internal use of the Fresk within a company, an association, a foundation, public body or local authority does not constitute a non-commercial use as defined in this paragraph, even if it does not give rise to a direct financial compensation (see “internal use within an organisation”).

Commercial use

For commercial use, i.e. use subject to direct financial compensation, a usage fee equal to 10% of the amount of such compensation, excluding tax, will be charged. This applies to workshop activities as well as to facilitators’ training and to any other service linked to the use of the Fresk.
When the commercial service is provided following a referral by the Association, which assigns incoming requests, referral fees (10% excl. VAT on sales excl. VAT) apply in addition to the usage fee. These referral fees are due on all services provided to the client (including services non-related to the use of the Climate Fresk), for a period of 12 months following the initial referral.
In-company training (continuous training) is regarded as commercial use.
The fee is due by the service provider thus paid, and collected by the Association “La Fresque du Climat”, which allows the Association to finance distribution via the associative networks and the non-commercial use.

Internal Use Within an Organisation

For internal use within a private organisation, without the support of an external facilitator, paid for this purpose, the usage fee is €5 excl. VAT (€6 VAT included) per participant. This applies to Climate Fresk workshops, as well as training sessions.

In the case of internal use within a public sector organisation and associations, the licence fee is fixed at €3 excluding VAT (€3.60 including VAT) per participantThis applies to Climate Fresk workshops, as well as training sessions.

These user fees are distinct from the amounts that service providers may charge to organisations for services such as facilitating or training.

The use of Climate Fresk in a primary, secondary or higher education establishment for staff is not covered by this category of use.

Reporting Periods for Usage Fees

Usage fees reporting is required on a quarterly basis. As such, external or internal workshops or training courses carried out during a quarter should be reported no later than the 15th of the month following the end of the quarter.

  • April 15th: Deadline for reporting of services carried out in January, February and March
  • July 15th: Deadline for April, May and June
  • October 15th: Deadline for July, August and September
  • January 15th: Deadline for October, November and December

Sponsorship and communication

No organisation may, without the approval of the Association, communicate the fact that it is sponsoring Climate Fresk workshops or training courses for another entity or for the public, or that a partnership has been agreed with the Climate Fresk.
Any such communication must be approved by the communication manager of the Association, who will reply after consulting with the Author.

Non-modifiable nature of the tool

The non-modifiable nature of the tool relates to its use under the three categories aforementioned (free use, commercial use, internal use in a professional context within an organisation).
Modifying the cards of the Climate Fresk without the prior agreement of the Association “La Fresque du Climat” is strictly forbidden.

Modifications of the work include, in particular, but not limited to, the following:

  • Modifying any of the 44 cards (23 cards for the children’s version) or the Fresque Quiz
  • Removing more cards than what is allowed in the simplified version
    Adding cards to the Fresk at any time during the workshop (creation of the Fresk, creative phase, feedback or debrief)
  • Delivering top-down information during the debriefing for more than 5 minutes unless it is scientific information that provides clarification on the causes and consequences of climate change or the orders of magnitude for the transition;
  • Conducting a workshop in less than 3 hours

The reproduction of La Fresque du Climat materials by removing references to the website or the Author, or by adding a logo or the identification of an association or company, is expressly forbidden.
Any violation of these terms may result in legal action by the Author and the Association.

Modification of the cards

The Climate Fresk was created in 2015 and has been subject to a number of changes and adjustments. It has been updated with each new IPCC report. The pace of updates is slowing down over time, a sign that the content is stabilising.
Adaptations of the tool to a particular context or audience may be necessary, but always require prior written authorisation from the Association.

Licence Compliance Monitoring

The Association reserves the right to verify compliance with the licence and the payment of usage fees. This includes the possibility of an auditor attending an event in an organisation on behalf of the Association.

Disclosure of Amounts Paid as Usage Fees

Any company using the Climate Fresk for commercial or professional purposes accepts that the data on usage fees, which it is required to declare, will be made public. This applies to service providers paying a 10% fee on their invoices, to private organisations paying €5 excl. VAT and to public sector or non-profit organisations paying €3 excl. VAT.
The information will be accessible to certain members of the Association such as Climate Fresk employees, country or local coordinators, trainers and instructors.
The information on fees for internal use will be used to showcase the companies implementing the Fresk on the website of the Association.

Registered trademark

The name “La Fresque du Climat” is a registered trademark, used in particular to refer to training services. As a result, any imitation or use of the material as a basis for any training activity is prohibited, as is any use of the material other than that authorised for use as an educational tool.

Use of the Term “Fresque” / “Fresk”

As the term “fresque” in French is a common noun, using it to designate a workshop based on the same pedagogical concepts as the Climate Fresk is not prohibited.
This is not the case for the term “Fresk” (see paragraph below).

International Trademark

The term “Climate Fresk” is registered worldwide. Using the word “fresk” in combination with another term to create an alternative workshop name (such as Digital, Biodiversity etc.) will be regarded as a trademark infringement and will result in legal action.

Updates

This licence is subject to potential changes. Users of the Climate Fresk are requested to stay up-to-date with any such changes.
